Agent and Business Lister Advertising Terms

1. Application

1.1 These terms apply to anyone who places advertisements on Letalife in the course of a business, including letting agents, property managers, relocation agents, companies, and landlords letting property as a business (each an "Agent Lister"). They supplement the Letalife Terms of Use, which continue to apply; if there is a conflict in relation to advertising, these terms prevail.

1.2 By placing an advertisement as an Agent Lister you confirm that you have authority to bind the business on whose behalf you act, and "you" in these terms means that business.

1.3 In these terms, "Advert" means any advertisement, listing, photograph, description, or profile content you submit to Letalife.

2. Letalife's role

2.1 Letalife publishes your Adverts and provides a channel through which prospective tenants can contact you. Letalife does not act as your agent or sub-agent, does not carry out lettings agency work or lettings work on your behalf or on behalf of any landlord, and is not a party to, and accepts no responsibility for, any instruction, tenancy, occupation contract, or other arrangement between you, your client landlords, and prospective tenants.

2.2 You remain solely responsible for compliance with every legal obligation that applies to you and to your Adverts. Letalife providing fields, prompts, mandatory inputs, or moderation does not transfer any of your obligations to Letalife, does not constitute legal advice, and does not amount to confirmation that a published Advert is compliant.

3. Your regulatory warranties

You warrant and undertake, on placing each Advert and on a continuing basis while it is published, that:

3.1 Entitlement. You are lawfully entitled to advertise the property, with the authority of its landlord where you act as agent, and the property may lawfully be let as advertised.

3.2 Accuracy and material information. The Advert is accurate, not misleading, and includes all material information the average consumer needs to make an informed transactional decision, as required by Chapter 1 of Part 4 of the Digital Markets, Competition and Consumers Act 2024, including the total price of the tenancy so far as ascertainable (rent, deposit, and any unavoidable fees) and the information collected in Letalife's mandatory listing fields (EPC band, council tax band, deposit, availability, minimum term). You will correct or withdraw an Advert promptly if it ceases to be accurate (including when the property is no longer available).

3.3 Lister identity. You have declared your lister type truthfully and will not present yourself, or permit any Advert to present you, as a private individual. You acknowledge that Letalife displays lister type (and agency name, where applicable) on published listings and that it does so to comply with its own obligations under consumer protection law.

3.4 Redress (England). Where you carry out lettings agency work in relation to premises in England, you are and will remain a member of a government-approved redress scheme as required by the Enterprise and Regulatory Reform Act 2013, and the scheme details you supply to Letalife are accurate and current.

3.5 Fees publicity and client money protection (England). Where section 83 of the Consumer Rights Act 2015 applies to you: you have supplied to Letalife, for display with your Adverts or profile, a list of your relevant fees or a link to the page of your own website where that list is published, as section 83(3C) requires of an agent advertising on a third-party website; that list complies with section 83(4)–(6); and the client money protection and redress statements you supply are accurate. You acknowledge that Letalife provides the display surface only: keeping the fee information accurate, complete, and current is your obligation, not Letalife's.

3.6 Prohibited payments. No Advert advertises, and you will not require in connection with any resulting tenancy, any payment prohibited by the Tenant Fees Act 2019 (England), the Renting Homes (Fees etc.) (Wales) Act 2019, or the legislation prohibiting premiums in Scotland, as applicable to the property's location.

3.7 Scotland. For any property in Scotland: the Advert includes the landlord's registration number (or the words "landlord registration pending") as required by section 92B of the Antisocial Behaviour etc. (Scotland) Act 2004; and, where you are a letting agent, your letting agent registration number is included as required by the Housing (Scotland) Act 2014 and you comply with the Letting Agent Code of Practice.

3.8 Wales. For any property in Wales: the landlord is registered with Rent Smart Wales; you (or the landlord, if self-managing) hold any licence required under Part 1 of the Housing (Wales) Act 2014 for the lettings work being carried out; and any registration or licence number required to appear in advertisements is included in the Advert.

3.9 General compliance. Your Adverts and your conduct in dealing with enquirers comply with all other applicable law, including the Equality Act 2010 (no discriminatory advertising or lettings criteria), right-to-rent legislation where applicable, and data protection law in respect of enquirers' personal data passed to you (see clause 6).

4. Mandatory fields and verification

4.1 Letalife may make any disclosure field mandatory at ad creation for Agent Listers (including redress scheme, client money protection, fees list or link, and country-specific registration or licence numbers) and may decline to publish an Advert until they are completed.

4.2 Letalife may — but is not obliged to — check any information you supply against public registers or schemes, and may ask you for evidence of any warranty in clause 3. Failure to provide evidence within a reasonable time is grounds for suspension of your Adverts.

4.3 No moderation, approval, field validation, or verification step performed by Letalife reduces or transfers your responsibility for your Adverts.

5. Suspension, removal, and regulator cooperation

5.1 Letalife may suspend or remove any Advert, or suspend or terminate your account, immediately and without liability where it reasonably considers that: an Advert breaches clause 3 or the Terms of Use; information you supplied is or may be false; you have misdeclared your lister type; a redress scheme, registration, or licence you rely on has lapsed; or a regulator, redress scheme, court, or law enforcement body requests or requires it.

5.2 You will notify Letalife at compliance@letalife.com within 5 business days if: your redress scheme membership, client money protection membership, or any registration or licence relevant to your Adverts lapses, is suspended, or is revoked; or you become subject to a banning order, enforcement notice, or prosecution relating to lettings activity.

5.3 Letalife may disclose information about you and your Adverts to Trading Standards, the Competition and Markets Authority, redress schemes, Rent Smart Wales, Scottish local authorities, and other regulators or law enforcement where it reasonably considers disclosure appropriate.

6. Enquirer data

6.1 When Letalife passes an enquirer's details to you, you become an independent controller of that personal data. You must use it only to respond to and progress the enquiry, comply with UK GDPR and the Data Protection Act 2018 in respect of it, and not add enquirers to marketing lists without a lawful basis of your own. You are responsible for your own privacy information to enquirers.

7. Indemnity

7.1 You will indemnify and hold harmless Letalife, its operator, and its officers, employees, and contractors against all losses, liabilities, damages, costs, claims, fines, penalties, and expenses (including reasonable legal costs) arising out of or in connection with:

·         (a) any breach of these terms or of the warranties in clause 3;

·         (b) the content of your Adverts, including any claim that an Advert is misleading, omits material information, or infringes any third party's rights;

·         (c) any claim or complaint by a tenant, prospective tenant, landlord, or other person arising from your (or your client landlord's) acts, omissions, or defaults, including in relation to any tenancy or occupation contract resulting from an Advert;

·         (d) any regulatory investigation, enforcement action, or penalty concerning Letalife to the extent it results from your Adverts or your conduct, including any assertion that Letalife shares responsibility for a non-compliant invitation to purchase hosted on your behalf; and

·         (e) your handling of enquirers' personal data.

7.2 Letalife will notify you of any claim within a reasonable time, and you will not settle any claim in a way that admits fault on Letalife's part without Letalife's written consent. Letalife may conduct the defence of any claim against it, with your reasonable cooperation, at your cost where the indemnity applies.

8. Liability between us

8.1 Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded.

8.2 Subject to clause 8.1, and reflecting that the Service is currently provided to you free of charge: Letalife excludes all conditions, warranties, and terms implied by statute or common law; Letalife is not liable to you for loss of profits, business, opportunity, goodwill, or data, or for any indirect or consequential loss, including loss arising from the removal or non-publication of an Advert, suspension of your account, or unavailability of the Service; and Letalife's total aggregate liability to you in any 12-month period is limited to the greater of £100 or the fees (if any) you paid to Letalife in that period.

8.3 You acknowledge that you do not rely on Letalife for legal or regulatory advice and that responsibility for your compliance with lettings, consumer protection, and advertising law rests with you.

9. General

9.1 Letalife may update these terms on 14 days' notice by email or notice on the Service; continued advertising after the effective date constitutes acceptance. Clauses 5.3, 6, 7, and 8 survive termination.

9.2 These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction (these are business-to-business terms).
