1. Who we are and what these terms cover
1.1 Letalife ("Letalife", "we", "us") is operated by Jotnar Systems Ltd, a company registered in England and Wales, company number 11982020, registered office 5 Brayford Square, London, E1 0SG. You can contact us at legal@letalife.com.
1.2 These terms govern your use of the Letalife website and services (the "Service"), whether you browse listings, create an account, save searches, contact a lister, or place an advertisement.
1.3 If you place advertisements as a letting agent or otherwise in the course of a business, the Agent and Business Lister Advertising Terms also apply to you and, in the event of conflict, take precedence over these terms in relation to your advertising.
1.4 Our Privacy Notice explains how we handle personal data. It forms part of your agreement with us.
2. What Letalife is — and what it is not
2.1 Letalife is an advertising platform. We publish advertisements for residential property to let, disseminate information contained in those advertisements, and provide a means by which prospective landlords and tenants can make direct contact with each other and communicate. That is the whole of our role.
2.2 Letalife is not a letting agent, estate agent, property manager, landlord, or party to any tenancy, occupation contract, or other agreement you may enter into with a person you find through the Service. In particular, we do not:
· (a) act on the instructions of any landlord, tenant, or agent in relation to any letting;
· (b) arrange, negotiate, or conduct viewings;
· (c) carry out referencing, identity, right-to-rent, or affordability checks on any lister or enquirer;
· (d) hold, handle, or transmit rent, deposits, holding deposits, or any other money passing between listers and enquirers;
· (e) prepare, advise on, or witness tenancy agreements or occupation contracts; or
· (f) manage any property.
2.3 Because our activity is limited to publishing advertisements and providing a contact channel, we do not carry out "lettings agency work" within the meaning of section 83 of the Enterprise and Regulatory Reform Act 2013 or "lettings work" within the meaning of section 10 of the Housing (Wales) Act 2014, and we are not required to be, and are not, a member of a lettings redress scheme, licensed by Rent Smart Wales, or registered as a letting agent in Scotland. Regulatory obligations attaching to the advertising and letting of property rest with the landlords and agents who advertise.
2.4 Nothing in these terms, and nothing we do in operating the Service (including moderating or approving advertisements), creates any agency, partnership, joint venture, employment, or fiduciary relationship between Letalife and any lister or enquirer.
3. Listings are the lister's content, not ours
3.1 Every advertisement on the Service is created and submitted by the lister (a landlord, letting agent, or other business). The lister — not Letalife — is responsible for the accuracy, completeness, lawfulness, and currency of their advertisement, including price, fees, deposit, EPC and council tax information, availability, property condition, photographs, and any registration or licence numbers.
3.2 We review advertisements before publication as a quality-control measure and we require certain information fields to be completed. Our review and approval of an advertisement is not verification of its contents and is not an endorsement of the lister or the property. We do not inspect properties, we do not verify that a property exists or is as described, and we cannot guarantee that a lister is who they say they are or is entitled to let the property.
3.3 Where a lister's redress scheme membership, client money protection details, fees information, or registration or licence numbers appear on the Service, that information is supplied by the lister and published on their behalf so that the lister can meet their own legal obligations. We do not confirm it with the relevant scheme or register.
3.4 You should carry out your own checks before entering into any agreement or paying any money. In particular, we strongly recommend that you: view a property in person before paying anything; verify a landlord's or agent's identity and, where applicable, their registration, licence, or redress scheme membership with the relevant official register or scheme; and never send money by irreversible transfer to someone you have not met. 4. Your dealings with other users are at your own risk
4.1 Any tenancy, occupation contract, viewing, negotiation, payment, or other dealing between you and another user of the Service is solely between you and them. We are not a party to it, we do not supervise it, and — to the extent permitted by law — we accept no responsibility for it.
4.2 To the extent permitted by law, we are not responsible for: the acts, omissions, statements, or defaults of any lister, landlord, agent, or enquirer; the condition, safety, legality, or availability of any advertised property; the failure of any letting to proceed; or any loss you suffer as a result of relying on the content of an advertisement.
4.3 Clause 4.2 does not affect a lister's own legal responsibilities to you, your statutory consumer rights, or any right you may have to complain to a lister's redress scheme or to Trading Standards, and nothing in these terms excludes any liability of ours that cannot lawfully be excluded (see clause 12).
5. Accounts
5.1 You must be at least 18 to create an account or place an advertisement. You must provide accurate information when registering and keep it up to date, and you are responsible for keeping your credentials secure. You must tell us promptly at help@letalife.com if you believe your account has been compromised.
5.2 When you place an advertisement you must accurately declare whether you are advertising as a private individual or in the course of a business (including as a letting agent or portfolio landlord). It is an offence under consumer protection law for a trader to create the false impression of acting as a private individual, and we display the declared lister type on listings. Misdeclaring your lister type is a serious breach of these terms and will result in removal of your advertisements and may result in account termination.
6. Acceptable use
6.1 You must not use the Service to:
· (a) publish anything false, misleading, defamatory, discriminatory, or unlawful, including any advertisement that omits material information required by consumer protection law or advertises a payment prohibited by tenant fees legislation;
· (b) advertise a property you are not entitled to let, or that may not lawfully be let;
· (c) impersonate any person, misdeclare your lister type, or misrepresent your regulatory status;
· (d) harvest data, scrape the Service, or send unsolicited marketing to users;
· (e) attempt to circumvent our moderation, security, or bot-protection measures; or
· (f) upload malicious code or interfere with the operation of the Service.
6.2 Enquiry and messaging facilities may be used only for genuine enquiries about the advertised property.
7. Content you submit
7.1 You retain ownership of content you submit (including advertisement text and photographs). You grant us a non-exclusive, royalty-free, worldwide licence to host, reproduce, display, adapt (for formatting purposes), and distribute that content for the purposes of operating, promoting, and improving the Service, including in search-engine surfaces and email digests, for as long as the content remains on the Service and for a reasonable period afterwards for archival, audit, and legal purposes.
7.2 You warrant that you own or have the necessary rights in everything you submit, that photographs are of the actual property advertised, and that your content does not infringe anyone's rights or breach any law.
8. Moderation, removal, and reporting
8.1 We may (but, except where the law requires, are not obliged to) review, decline, edit for formatting, suspend, or remove any advertisement or other content at any time, and suspend or terminate any account, where we reasonably consider there has been a breach of these terms, a legal requirement, or a risk to users — or where we are required to do so by a regulator, court, or law enforcement.
8.2 If you believe a listing is fraudulent, misleading, or otherwise non-compliant, report it using the report function on the listing or by email to abuse@letalife.com. We will review reports and take the action we reasonably consider appropriate.
8.3 We may share information with regulators, redress schemes, and law enforcement where we reasonably consider it necessary (see our Privacy Notice).
9. Availability of the Service
9.1 The Service is currently provided free of charge. We aim for high availability but the Service is provided on an "as is" and "as available" basis: we do not guarantee that it will be uninterrupted, error-free, or that any particular listing, saved search, or email digest will be delivered or remain available.
9.2 We may change, suspend, or withdraw all or part of the Service. If we make a change that materially disadvantages you, we will give reasonable notice where practicable.
10. Intellectual property
The Service, its design, software, gazetteer, and databases are owned by us or our licensors. You may use the Service for private, non-commercial purposes (or, for listers, for placing and managing your own advertisements). You must not copy, scrape, or republish the Service or any substantial part of our databases without our written permission.
11. Suspension and termination
11.1 You may close your account at any time using the self-service deletion facility (subject to the cooling-off period described in the Privacy Notice).
11.2 We may suspend or terminate your account for breach of these terms, for legal or regulatory reasons, or on reasonable notice for any other reason. On termination, your advertisements will be removed; clauses that by their nature should survive (including 4, 7.1, 12, and 13) survive.
12. Our liability
12.1 Nothing in these terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation by us; or any other liability that cannot be excluded or limited by law. Nothing in these terms affects your statutory rights as a consumer.
12.2 Subject to clause 12.1, we are not liable for: the content of advertisements or other user content; the acts or omissions of listers, landlords, agents, or enquirers; loss or damage arising from dealings between users; or loss or damage that is not a foreseeable result of our breaking these terms.
12.3 Subject to clause 12.1, where you use the Service in the course of a business: we exclude all implied terms to the fullest extent permitted; we are not liable for loss of profit, business, goodwill, or data, or for any indirect or consequential loss; and our total aggregate liability to you is limited to the greater of £100 or the amount you have paid us for the Service in the 12 months before the claim arose.
12.4 The Service is provided free of charge during the current launch period. Subject to clause 12.1, our total aggregate liability to a consumer in respect of the free Service is limited to £100.
13. General
13.1 We may update these terms. We will publish the updated version with a new "last updated" date and, for material changes affecting account holders, give notice by email or on the Service. Continued use after the effective date constitutes acceptance.
13.2 If any provision is found unenforceable, the remainder continues in effect. A failure to enforce a right is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours to a successor of the Service, subject to your rights being unaffected.
13.3 These terms are governed by the law of England and Wales. If you are a consumer resident in Scotland, you may also rely on the mandatory protections of Scots law and bring proceedings in Scotland; consumers may bring proceedings in the courts of the part of the UK in which they live.
13.4 If you are unhappy with the Service, contact us at help@letalife.com. Complaints about a lister's conduct should also be directed to the lister and, where the lister is an agent, to their redress scheme (The Property Ombudsman or the Property Redress Scheme).
